C.R.S. 22-9-106
C.R.S. 22-2-l 12(1)(g)(I): Local Boards of Education -Duties/Performance Evaluations Commissioner Duties
Rationale: Aspen Community School must have the ability to perform the evaluation of all personnel. Should any designated administrators not have a Type D certificate, this should not preclude him or her from administering the evaluations under the direction of the head of school. Additionally, Aspen Community School will not be required to report their teacher evaluation ratings as a part of the commissioner’s report as required by C.R.S. 22-2-l 12(1)(q)(l).

Replacement Plan: Aspen Community School uses its own evaluation system as agreed to in the charter school contract with Aspen School District. This evaluation system will continue to meet the intent of the law as outlined in the statute. Staff has been trained in this evaluation system and the methods used for Aspen Community School’s evaluation system include quality standards that are clear and relevant to the administrators’ and teachers’ roles and responsibility, have the goal of improving student academic growth, and meet the intent of the quality standards established in SB 10-191. Aspen Community School will not be required to report their teacher evaluation data; however teacher performance data will be reviewed by the school and used to inform hiring practices and professional development.

C.R.S. 22-32-109(1)(n)a): Local Board Duties – School Calendar
Rationale: Aspen Community School complies with Colorado law in providing the required number of school days and contact hours, but establishes its own annual school calendar.
Replacement Plan: Aspen Community School will establish the annual school calendar.
C.R.S. 22-32-109(l}(n}CTI}(B): Local Board Duties -Adopt District Calendar
Rationale: Aspen Community School complies with Colorado law in providing the required number of school days and contact hours, but establishes its own annual school calendar.
Replacement Plan: Aspen Community School will establish the annual school calendar.
C.R.S. 22-32-120: Food Services
Rationale: The Aspen Community School does not have a food-service facility and does not offer food-service to students.
Replacement Plan: Aspen Community School students provide their own snacks and lunches.
